Summary
Ed Rolwes is a partner in the firm’s litigation practice group, focusing primarily on commercial and professional liability litigation and risk management.
Ed’s commercial litigation experience includes litigation of commercial contract suits with an emphasis in construction and real estate litigation, as well as litigation related to employment disputes including covenants not to compete and related claims. Ed’s significant real estate litigation experience includes litigation related to development agreements, contractor/ subcontractor disputes, mechanic’s liens, boundary disputes, easement disputes, and general breach of contract claims.
In addition to his extensive litigation experience, Ed also has an expertise in the area of alternate dispute resolution of commercial litigation matters and has successfully resolved numerous matters on behalf of clients through mediation and arbitration. Ed is an approved arbitrator with the United States District Court for the Eastern District of Missouri and with United States Arbitration and Mediation Services.
In addition to his expertise in the area of commercial litigation, Ed also has significant experience and expertise in the area of commercial leasing litigation in both state and federal court and the drafting of equipment lease documents including funding agreements and master lease agreements.
Ed also has extensive experience representing professionals. For over 20 years, Ed has regularly represented scores of professionals in liability and risk management matters including lawyers, accountants, insurance brokers and agents, real estate brokers and agents and their professional corporations in both litigation and risk management matters. Ed’s professional liability/risk management experience also includes extensive experience representing medical related professionals including risk management services for nursing home providers, consultation services regarding compliance with subpoenas and records requests including analysis of HIPAA related issues as well as extensive experience representing dentists and their professional corporations in litigation in both Missouri and Illinois.
Due to his expertise in the area of professional liability law, Ed has been requested on numerous occasions to represent attorneys and law firms in litigation and in proceedings before state ethics authorities including the Office of Chief Disciplinary Counsel for the State of Missouri. Ed is a recognized authority in the area of attorney liability and risk management and has published numerous articles related to attorney liability issues. Ed’s experience also includes medical malpractice litigation, insurance coverage consulting, probate and fiduciary litigation, landlord/tenant litigation as well as litigation before various accounting related authorities including SIPC and the SEC.
